A defendant shall be punished by imprisonment with prison labor for up to six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

From January 3, 2018 to February 2018, the Defendant was a person who was appointed as a sales salesperson from “C” to “C” for the sale of the Incheon Used Motor Vehicle located in Dong-gu, Incheon, Dong-gu, Incheon, as a used motor vehicle seller.

[2018 Highest 2262 / [202] The Defendant: (a) had a customer who purchased a used motor vehicle as if it was sold at a low-end motor vehicle price; and (b) notified the customer that it is impossible to cancel the sales contract by pretending that the registration was made for transfer of the name of the vehicle; and (c) had the relevant used motor vehicle imported from a foreign country and paid additional expenses; (b) had the customer obtain money from the customer by soliciting him/her to purchase another used motor vehicle and sell it.

On January 7, 2018, the Defendant sold the E-learning vehicle to the victim D who purchased a used vehicle at the above trading company around January 7, 2018.

It is false to the effect that the current contract to be entered into by the Party and the contract to be entered into by the Party with a copy of the Party's driver's license and the contract to be entered into by the Party, and that this is false to the effect that "I wish to enter into the vehicle registration and insurance if I inform the victim of the copy of the Party's driver's license and the driver's resident registration number to be added to the vehicle's insurance."

In this context, “D' means false statement to the effect that it is, and again, the office and the victim return to the office is the vehicle imported from a foreign country, so the amount of KRW 7 million is required for additional costs, such as customs duties.

A false statement was made to the purport that the above-learning vehicle has already been registered as a motor vehicle so that it is impossible to cancel the contract and can replace other motor vehicles, and it is similar to the similar one,830,000 won.

However, in fact, the vehicles, the reasonable market price of which was about 9.1.8 million won, could not be sold at KRW 3.25 million from the beginning.
