1. The plaintiff's claim is dismissed.

1. Basic facts

A. On April 26, 2013, the Defendant issued a public notice of construction electronic bidding (hereinafter “instant public notice of tender”) with the following details under the Ministry of Land, Infrastructure and Transport No. 2013-16 of the Water Supply and Waterworks Installation Act.

4. Qualifications for participation.

가. 「지방자치단체를 당사자로 하는 계약에 관한 법률 시행령」제13조 및 동법 시행규칙 제14조의 규정에 의한 자격을 갖추어야 하며, 건설산업기본법에 의한 종합공사를 시공하는 업종 중 【토목공사업 또는 토목건축공사업】을 보유하고 있는 업체이어야 합니다.

(b) A company that has completed a single construction project within the last ten years as of the date of the public announcement of tender (limited to the volume of the sewage culvert in the case of a complex construction project connected to the business of a sewage terminal treatment plant), or a sewage culvert (including a drainage facility), or a tea culvert (limited to the volume of the tea culvert in the case of a complex construction project connected to the business of a sewage terminal treatment plant), the total length of which is at least 32 km (limited to the volume of the tea culvert in the case of a complex construction project connected to the business of a sewage terminal treatment plant)

(d) will only be allowed to participate in the performance and not be given separate notice to a performance-accredited enterprise by submitting a performance certificate;

- Construction: The defendant joining the defendant (75%) and the tri-company (25%) - the total construction size: L=50,900m L=2,540m L=13,926m L=13,926m L=7,62m D200mD 200mD 250m, D250m L=11,496m, D300m L=6,036m for total extension of the tea culvert.
