A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

[2014 Highest 1513] On November 5, 2013, the Defendant posted a false letter to the effect that “sale of crowdfunding” on the bulletin board of the smartphone display room, and then sent a text message to the victim C who reported and contacted the text message to the effect that “on the face of sending money, sending the message.”

However, even if the defendant receives the money from the victim, he/she did not have any intention or ability to send a package trading.

Nevertheless, the Defendant, as such, by deceiving the victim and receiving 200,000 won from the victim to the new bank account under the name of the Defendant as the price for the goods, and acquired it through the above method 12 times in total from 12 persons, such as the victim C, etc. to the new bank account, etc. in the name of the Defendant from January 14, 2014.

[2014 Highest 1918] On October 15, 2013, the Defendant sent a text message to the effect that “I will sell a highest smartphone” on the bulletin board of the seat board of the smartphone display room, and then send a text message to the victim D who reported and contacted the text message to the effect that “I will send the money if you send it.”

However, even if the defendant receives the price of goods from the victim, he did not have the intention or ability to send a serious smartphone.

Nevertheless, the Defendant, as such, by deceiving the victim, received 130,000 won from the victim to the new bank account under the name of the Defendant as the price for the goods, and acquired them by transfer from eight persons, such as the victim D, etc. to the new bank account in the name of the Defendant from November 29, 2013 through eight times in total as shown in the attached Table 1 of Crimes from that to November 29, 2013.
