Defendant shall be punished by imprisonment for not less than two years and six months.

The defendant shall complete the sexual assault treatment program for 80 hours.

Punishment of the crime

[2015 Gohap38] The Defendant unilaterally notified the victim C (n, 21 years of age) and the victim from October 2013 to June 2014, and led the victim to the awareness of his/her religion.

피고인은 2014. 6. 19. 09:00경 부산 북구 D에 있는 피해자의 집에 이르러 피해자와 교제하면서 알고 있던 피해자의 집 현관문 번호를 누르고 집 안으로 침입한 다음 방 안 침대 위에 누워 있던 피해자에게 다가가 피해자에게 “다시 잘 해보려고 왔다.”라고 하면서 피해자를 안았고, 피해자가 “진짜하지 마라. 지금 남자친구에게 미안하다. 난 싫다.”라고 말하면서 피고인을 밀어내고 거부하자 피해자에게 “나랑 사귈 당시 네 동영상이 있다. 네 얼굴 적나라하게 찍혔다.”라고 협박을 하여 피해자의 반항을 억압한 후 피해자의 몸 위로 올라가 피해자를 간음하여 강간하였다.
