A defendant shall be punished by imprisonment for not less than one year and six months.

Punishment of the crime

On December 13, 2010, the Defendant was sentenced to a fine of one million won for a crime of violating the Road Traffic Act at the Daejeon District Court on December 13, 201, and was sentenced to a fine of 1.5 million won for a crime of violating the Road Traffic Act at the same court on August 10, 201, and on May 6, 201, the Defendant was sentenced to a suspended sentence of 10 months for a crime of violating the Road Traffic Act (driving) at the same court on May 14, 2015, and the said judgment became final and conclusive on May 14, 2015.

1. On May 23, 2016, the Defendant: (a) driven a motor vehicle under the influence of alcohol level of 0.128% while under the influence of alcohol level of 0.128%, without obtaining a driver’s license from the front side of the C cafeteria located in Daejeon-gu, Daejeon-gu, to the front side of the Daejeon-gu, Daejeon-gu, Daejeon-gu, the Defendant driven a motor vehicle under the influence of alcohol level of 0.128%.

As a result, the Defendant violated the prohibition of drinking under the Road Traffic Act not less than twice, and driving a motor vehicle without obtaining a driver’s license in a drunken state in violation of the said provision.

2. On July 21, 2016, the Defendant was driving a motor vehicle in the direction of about 500 meters from the direction of the Ambassador-dong, Daejeon, Daejeon to the 85-2 Bolle Park, Jung-gu, Daejeon to the front road without obtaining a driver’s license for the vehicle in the direction of about 500 meters to the front road.

3. On July 30, 2016, the Defendant violated the Road Traffic Act (drinking driving) and the Road Traffic Act (Dless driving) driving a vehicle under the influence of alcohol of about 0.161% while under the influence of alcohol during blood without obtaining a driver’s license from the front side of Daejeon-gu, Daejeon to the front side of the hotel, a shower in the Dong-dong, Daejeon-gu, Daejeon-gu, for about 5km.

As a result, the defendant has violated the prohibition on drinking under the Road Traffic Act not less than twice, and has a motor vehicle without obtaining a driver's license under the influence of alcohol in violation of the said provision.
