Purport of claim and appeal

1. The following facts do not conflict between the parties, or each of the entries in Gap evidence 1-1 to 4, Gap evidence 2, 3, 5, Eul evidence 1-3, Eul evidence 1-2, and Eul evidence 4 to 6 may be admitted after compiling the whole purport of the pleadings.

The Plaintiff (formerly, the Plaintiff (formerly, the Plaintiff was the “Gangnamic Co., Ltd., but changed to the current trade name on June 19, 2015) is the agent of the Gangnam-si Co., Ltd. (hereinafter referred to as the “Gangnamsung”), which is the seller of the contact. The Defendant is the manufacturer and seller of packing materials, and the Plaintiff has supplied the contact to the Defendant since 201.

B. Around June 2012, the Defendant produced and sold packing materials using a contact solution supplied by the Plaintiff, and there was a defect due to defective arrival in the packing materials.

C. The Defendant asserted that the foregoing defect occurred due to the inferior quality of the contact offered by the Plaintiff, and demanded the Plaintiff to compensate for damages amounting to approximately KRW 90,00,000, and thereafter, the Plaintiff and the Defendant discussed several times on June 5, 2013 (hereinafter “instant consultation”).

1. The outstanding amount of KRW 45,000,000 shall be settled from Jinia (Defendant) to Jinia (Defendant) by December 2, 2013.

2. He/she shall visit the JUB-385S-60 inferior cases during six months, such as the Gangnam Research Institute and the Business Headquarters, and shall hold a technical consultation.

3. The Gangnam-UB-385S-60 and other Regrt contact values shall be reduced to KRW 700 per kilogramg from existing 5,500 to KRW 4,800/km.

(64T volume reduction is KRW 44,800,000 (=64,000 x 700) (=64,00 x 700). D.

The supply transaction between the Plaintiff and the Defendant was suspended on July 2014, and the Defendant did not pay KRW 57,314,960 out of the supply price of the contact.

On the other hand, the Plaintiff agreed on the instant case.
