A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Any person who violates the Act on Special Cases concerning Regulation and Punishment of Speculative Acts, etc. and the Promotion of the Game Industry Act shall not engage in speculative acts as a business by using speculative gaming machines, and shall not exchange tangible and intangible results acquired through the use of game products;

Nevertheless, from March 9, 2013 to March 15:10, 2013, the Defendant installed 1st floor (330 square meters) of a light-friendly game machine in Gyeyang-gu, Gyeonggi-gu, Gyeonggi-do, the Defendant: (a) installed 84 units of a light-friendly game machine, which is a speculative machine; (b) implemented programs, such as "Yamato", "htom", "htom", "htom", and "lue stick"; and (c) issued 30,00 h to unspecified customers who find the place thereof; and (d) had them obtain a large quantity of slots discharged from the game machine in accordance with the number or arrangement of the games displayed on the screen of the game machine operated by inserting the h to the game machine; and (e) had customers obtain a large quantity of 300,000 won of the game machine by means of having them acquire 300,000 won of the game machine (300,00 won of the game machine).

As a result, the defendant carried out speculative activities using speculative gaming machines as a business and exchanged the results obtained through the use of game products.

2. No person who violates the Act on Special Measures for Designation and Management of Development Restriction Zones shall alter the purpose of use of buildings without obtaining permission from the Governor of a Special Self-Governing Province or the head of a Si/Gun/Gu;

Nevertheless, on February 20, 2013, the Defendant leased one floor (330 square meters) of the light steel-frame building in Soyang-gu, Gyeonggi-gu, Gyeonggi-do, Gyeonggi-do, which is a development-restricted zone, from E, and installed 84 mar-friendly game machine (a mechanical slot machine), which is a speculative machine, from March 9, 2013 to March 12, 2013, without obtaining permission from the head of Gyeyang-gu.
