1. The punishment against the defendant B shall be one year;

2. A fine for negligence against Defendant A 4,00.

Punishment of the crime

1. Defendant B

A. From October 2006, Defendant B had been jointly engaged in the business of importing and selling second-hand horses with Defendant A, a joint Defendant A, but the enemy accumulated and failed to supply them to the Customer as of December 2007. While Defendant B did not have any intent or ability to supply second-hand horses despite having no claim for attempted payment or other property, Defendant B did not have any intent or ability to supply second-hand Rausing even with Defendant D.

Nevertheless, on March 19, 2009, Defendant B received 9,105,440 won in total 10 times from the victim, as shown in the attached Table of Crimes (1) by July 2010, and acquired 9,105,440 won in total from July 10, 201, as shown in the attached Table of Crimes (1).

B. Defendant B, as in the preceding paragraph, operated F with the joint Defendant A and the joint Defendant A, but the enemy accumulated with the accumulated amounting to KRW 99,105,440,00 for the victim’s obligation to supply to the victim, as well as Defendant B’s four business partners, including G et al., which are the other business partners of Defendant B, shared Defendant A with approximately KRW 147,50,000,000, and settled the partnership business with Defendant A.

However, Defendant B did not have the ability to supply a second-hand smoking even after receiving the secondhanding from the victim in advance.

Nevertheless, Defendant B, at the F Office on October 14, 2010, made a false statement to the effect that the Defendant B would import the middle-maning in Japan from the victim, and that it received KRW 90 million from the victim, and Defendant B thereafter received the remittance from the victim. From that time until December 2011, the sum of KRW 35,587,000 is more than 10 times, such as the list of crimes (2).
