A defendant shall be punished by imprisonment for six months.

Punishment of the crime

[Criminal Power] On October 22, 2012, the Defendant was sentenced to imprisonment with prison labor for the obstruction of performance of official duties, etc. in the Daegu District Court’s Ansan Branch on October 22, 2012. On June 15, 2013, the Defendant completed the execution of the sentence in the Ansan Prison.

【Criminal Facts】

1. On April 12, 2015, the Defendant was under the influence of alcohol at around 0.272% of blood alcohol level on April 15, 2015, the Defendant driven a B-temp motor vehicle from the 30km section from the front of the community hall located in the 2-14th Yan-gun of Yannam-gun of Gyeongnam-gun of Gyeongnam-do to the front road of the 27-40km-si of Yan-si of Yannam-gun of Yannam-gun to the front road of the Yannam-si of Yan-si.

2. On April 12, 2015, the Defendant violated the Act on Special Cases Concerning the Settlement of Traffic Accidents: (a) driven the said car on April 15, 2015; (b) driven the said car to the tin-ri community hall, while driving from the boundary of the tin-ri port to the front line of the tin-ri port located in 27-40, a day-to-day front line of the tin-ri west-gun, Chungcheongnam-gun, Chungcheongnam-do.

In such cases, a person engaged in driving of a motor vehicle shall accurately operate the steering system, brakes, and other devices of the motor vehicle, shall not drive the motor vehicle at a speed or in such a manner as to inflict any danger and injury on others, depending on the traffic conditions of the road and the structure and performance of the motor vehicle, and has a duty of care to report the traffic conditions on the front side well and prevent accidents in advance by safely driving.

Nevertheless, the Defendant neglected this and went under the influence of alcohol as set forth in Paragraph 1, and went away from the road to the left-hand side of the proceeding direction, and conflict with the part of the Defendant, such as the left-hand shoulder, etc. of the victim C(W, 76 years old) who was working in dry field.

The Defendant caused the victim to suffer the left-hand shoulder and arms that need to be treated for about two weeks by occupational negligence as above.
