1. Disposition on the return of an application filed by the Defendant for the installation of livestock excreta discharge facilities to the Plaintiff on May 29, 2018, and on May 30, 2018.

Details of the disposition

On January 31, 2013, the Plaintiff acquired the ownership of land (hereinafter referred to as “each of the instant land,” and when referring to individual land, referring to the parcel number) from Gangwon-gun, C, D, E, and F, and operated a double farm in the name of “G” from the stable facilities (specific buildings existed at the time of June 2016 are as shown in the annexed Form 1 in the annexed Form 1; hereinafter collectively referred to as “the instant stable facilities”).

원고는 구 가축분뇨의 관리 및 이용에 관한 법률 부칙(법률 제12516호, 2014. 3. 24. 이하 ‘구 가축분뇨법 부칙’이라 한다) 제8조(가축사육제한구역의 배출시설에 관한 특례) 규정에 따라 무허가 축사의 적법화 절차를 이행하기 위하여 2017. 12. 22. 피고에게, 불법건축물 자진신고서를 제출하고 2018. 1. 29. 건축법에 따른 이행강제금 16,063,290원을 납부한 다음, 2018. 1. 30. 이 사건 축사시설 중 별지 1 도면 중 양계장 7개동(‘ㅇ’, ‘ㅈ’, ‘ㅊ’, ‘ㄹ′’, ‘ㅁ′’, ‘ㅂ′’, ‘ㅎ’ 부분이다)과 계분처리장 1개동(‘ㅂ’ 부분이다. 이하 위 양계장 7개동과 통틀어 ‘이 사건 축사’라고 한다)에 대하여 동ㆍ식물관련시설(축사) 용도로 건축허가 신청서를 제출함과 동시에, 위 양계장 7개동을 가축분뇨배출시설로, 위 계분처리장을 가축분뇨처리시설로 하여 가축분뇨배출시설 설치허가신청서를 제출하였다

(2) The Plaintiff filed an application for permission for construction of livestock excreta discharge facilities and an application for permission for installation of livestock excreta discharge facilities (hereinafter “each of the instant applications”). On February 7, 2018, the Defendant filed a report on installation of livestock excreta discharge facilities with the Plaintiff on November 10, 198, on the ground that the report on installation of livestock wastewater purification facilities was accepted on November 10, 198, and filed a report on the installation of a kitchen (3,000 square meters) with the Plaintiff.
