피고인은 2014. 11. 7. 23:10경 부천시 원미구 B 앞 도로에서 자신이 운전하던 C 뉴그랜저 XG 차량을 운전하던 중 맞은편에서 진행하여 오던 D이 운전하는 오토바이가 자신의 차량 앞을 가로막자 화가 나 위 D에게 겁을 주기 위해 차량으로 위 오토바이를 밀어 붙였고, 이에 그곳에 있던 피해자 E(21세)가 열려진 피고인 차량 조수석 창문사이로 고개를 넣고 위와 같은 피고인의 행동에 대하여 항의하자 이를 무시한 채 위험한 물건인 위 차량을 그대로 출발하여 그 충격으로 피해자가 밖으로 튕겨져 나가며 도로 우측에 주차되어 있던 불상의 차량에 부딪치게 하여 위 피해자에게 10일간의 치료를 요하는 우 완관절 공소장 기재 “우 완골절”은 진단서에 비추어 볼 때 “우 완관절”의 오기임이 명백하다.
