A defendant shall be punished by imprisonment for two years.

Criminal facts

Under the influence of alcohol, the defendant committed the following crimes in a state that the defendant lacks the ability to discern things or make decisions:

1. Injury caused by indecent act by compulsion;

나. 피고인은 2013. 11. 3. 22:35경 위 C아파트 입구 앞길에서, 자전거를 타고 지나가는 피해자 E(여, 20세)에게 말을 걸어 이에 피해자가 멈추자 피해자를 끌어안고 목을 졸라 반항하지 못하게 한 후, 혀로 피해자의 볼을 핥고 손을 피해자의 상의 안으로 집어넣어 가슴을 만지고 피해자의 바지 위로 음부를 만지고, 이에 피해자가 발길질하는 등 저항하려 하자 피해자의 머리를 잡고 근처에 주차된 트럭 쪽으로 끌고 가 트럭 옆면에 피해자의 머리를 3~4회 박고 주먹과 발로 피해자의 얼굴과 전신을 10회 가량 때렸다.
