Defendant shall be punished by a fine of KRW 5,000,000.
When the defendant does not pay the above fine, 100,000 won.
Reasons
Punishment of the crime
1. The Defendant: (a) opened a mobile phone under another’s name in order to raise the cost of living, such as the mobile phone, and opened a mobile phone with C to offer money by means of distributing it through a mobile phone; and (b) even if opening a mobile phone under another’s name, there was no intention to pay the cost of telecommunications or the cost of a mobile phone.
Nevertheless, around February 20, 2014, the Defendant and C promised to give KRW 2 million in return for opening mobile phones to the nominal owner E in the Seo-gu D Building parking lot in Gwangju-gu, Gwangju, the following day of the following: (a) deceiving the staff in charge of the instant communications agency, the victim of whom is unable to know by preparing an application, etc. for joining mobile phones in the name of E along with E, from G agencies located in the North-gu, Gwangju, and sending it to the communications company; and (b) deceiving the staff in charge of the instant communications agency, the victim of which is the victim, through two mobile phoness in the name of E from the above communications company, by taking over KRW 3,064,751 from February 19, 2014 to February 21, 2014, by taking over KRW 7,009,691 in total through the list of crimes and four mobile phones in the name of another person.

On February 21, 2014, the Defendant and C opened the mobile phone in the name of E as described in paragraph (1) and, even if the credit card was issued, did not intend to use the mobile phone in selling it to China. However, on or after February 21, 2014, the Defendant and C obtained the credit card money and obtained it by means of settling KRW 300,000 of the vehicle rental cost by using the said credit card at the 21st rental car office located in the 894-5, Gwangju Northern-dong, Gwangju Metropolitan City, a limited liability company (hereinafter referred to as 894-5, a limited liability company).
