A. Status 1 of the Parties to Q Co., Ltd. (hereinafter “ Q”)

(2) On February 10, 2012, the Plaintiff entered into a business agreement and an agency contract (hereinafter “instant agency contract”) with Q and sales management trust contract (hereinafter “instant trust contract”) with the Plaintiff, Q, a contractor, and the Namwon Agricultural Cooperatives, a loan financial institution (hereinafter the loan financial institution was changed to the Incheon Savings Bank), with respect to the instant business in relation to Q on February 10, 2012. On the same day, the Defendants entered into a trust agreement with Q and sales management trust (hereinafter “instant trust agreement”).
B. The instant agency contract and the instant trust agreement concluded between Q and the instant trust agreement with the Plaintiff and the instant trust agreement include the following:
[The purpose of this case’s agency contract] Article 1(1) of the Act on the Sale of Buildings in Units (hereinafter “Building Act”) is to clarify the scope of business and the liability between the entity and the entity, and to efficiently manage trust property and sales revenue, thereby protecting buyers and smoothly carrying out this project.
