피고인은 2013. 5. 24. 08:30경 부천시 오정구 C 앞 노상에서 경기 부천오정경찰서 D파출소 소속 순경 E(28세)의 자동차관리법 위반 단속에 대해서 불만을 품고, E에게 “아침부터 짭새가 지랄이야. 무슨 문제야 재수 없는 새끼!”라고 욕하며, E의 몸을 손으로 수 회 밀치는 등 폭행하여 경찰관의 정당한 공무집행을 방해하였다.
