Punishment of the crime

Around 04:00 on June 20, 2018, the Defendant saw the victim’s proposal while drinking alcohol together with the Plaintiff’s home at the same time.

피고인은 2018. 6. 20. 07:30경 서울 강동구 C건물, 2층 ‘D마사지(이하 ’이 사건 마사지샵‘이라 한다)’에 있는 커플룸(이하 ‘이 사건 커플룸’이라 한다)에서 피해자와 함께 마사지를 받던 중 술에 취한 피해자가 잠이 들자 피해자의 항거불능 상태를 이용하여 피해자를 강간할 것을 마음먹고 성기를 드러낸 나체 상태로 자리에서 일어나 마사지사들에게 비키라고 지시하고, 이에 놀란 마사지사들이 마사지실 밖으로 나가자 피해자의 옆에 누워, 한 팔로 피해자를 끌어안고 다른 팔로 피해자의 어깨 부위를 누르고 피해자의 다리 위에 피고인의 다리를 올리며 피해자의 몸 위로 올라 타 피고인의 성기를 피해자의 음부에 삽입하려 하였으나 마침 이 사건 커플룸 밖에서 문틈으로 이를 목격한 종업원이 소리를 지르고, 이에 잠에서 깬 피해자가 몸 위에 올라탄 피고인을 발견하고 깜짝 놀라 피고인을 밀어낸 후 이 사건 커플룸 밖으로 도망하는 바람에 미수에 그쳤다.

Accordingly, the Defendant, while under the influence of alcohol, tried to rape the victim, using the victim's state of impossibility to resist.
