Defendant shall be punished by a fine of one million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

The defendant and B are the parents of D who registered as a Cparty preliminary candidate in January 30, 2020 in relation to the 21st National Assembly member election of April 15, 2020.

No one shall distribute, post, spread, play, or run an advertisement, letter of personnel management, poster, photograph, document, picture, picture, picture, printed matter, printed matter, recording, video tape and others similar thereto, which include contents supporting, recommending, or opposing a political party or candidate, or which indicate the name of a political party or candidate's name, in order to influence the election from 180 days before the election day to the election day.

At around 14:23, Feb. 18, 2020, the Defendant and B attached a tape with the name cards for D’s prospective ex post facto candidates on the front side of e-mail boxes installed on the first floor of 5, 6Ra, at the time of the Government-si, Ma-si, and attached 104 copies of D’s election purpose by continuously attaching the name cards in the same manner as 3, 4, 1 and 2 in the same manner.

Accordingly, the defendant posted printed matters indicating the candidate's name in collusion with B, not according to the Public Official Election Act in order to influence the election.

2. On February 26, 2020, the Defendant’s sole criminal defendant left the name of D, such as the description of paragraph 1 above, in front of the house located in G at Jung-si on February 14, 2020, and kept the name of D, in total, 16 of the name cards for election purpose by placing the name of D in the interior stairs of each house located in H, I and J while moving along the paths.

Accordingly, the defendant spreaded printed matters indicating the candidate's name without following the Public Official Election Act in order to influence the election.
