A Imprisonment with prison labor of one year and two months, and Defendant B shall be punished by imprisonment with prison labor of six months.
However, as to Defendant A, this shall not apply.
Reasons
Punishment of the crime
"2017 Highest 1673"
1. On May 2016, Defendant A loaned money to Defendant A at the office of the Gangnam-gu Seoul F building 8 and the office of the multi-level company called G to the victim H “G’s sular phone” to the victim H. It is reasonable to complete payment.

However, the defendant did not have any particular income as the bad credit holder at the time and did not have any intent or ability to repay the debt to other persons, such as credit card debt, even if he borrowed money from the injured party.
Nevertheless, on June 21, 2016, the Defendant: (a) by deceiving the victim; (b) received KRW 12 million from the victim; and (c) received delivery of KRW 100,000 from the Saemaul Treasury account of the Defendant on June 21, 2016.
2. On March 7, 2016, Defendant B, at the above G office, served in Syria where the U.S. former military personnel J was in the military service, and the amount equivalent to 18 billion won that he/she seized while performing his/her operations on the spot is found to have been invested.
If the money is brought to Korea and invested in G, a lot of benefits will remain, and the necessary expenses will be loaned."
However, there was no such fact that the Defendant was investing 18 billion won foreign capital or bringing about to Korea.
Nevertheless, the defendant deceivings the victim as such, and receives 2.5 million won from the victim to the above Saemaul Treasury account of A, and thereafter, he/she is carrying cash stuff into the Republic of Korea until May 5, 2016.

1. The Defendant served as a group leader of the multi-level marketing company called the Gangnam-gu Seoul F building eight floors from around December 2014 to October 2016.
