The appeal is dismissed.

The grounds of appeal are examined.

The lower court, on the grounds indicated in its reasoning, acquitted the Defendant on the ground that there was no evidence to prove the facts charged of assault and death.

In light of the record, the lower court did not err in its judgment by misapprehending the bounds of the principle of free evaluation of evidence against logical and empirical rules or by misapprehending the legal doctrine on the relation and predictability with the person who committed the crime of death by assault, contrary to what is alleged in the grounds of appeal.

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
