1. The Plaintiff:
A. Defendant B indicated in the separate sheet No. 11, 12, 17, 16, 11 among the 1st floor of the building listed in the separate sheet No. 1.
Reasons
1. Determination as to the cause of claim
A. The facts below the facts are acknowledged under the facts of recognition by taking into account each of the statements No. 1 through No. 11 (Ga number omitted) and the overall purport of the pleadings as a result of the plaintiff's newspaper, and each of the statements No. 1 to No. 5 (Ga number omitted) does not interfere with the above recognition as follows, and it is insufficient to reverse this only by the respective statements of No. 6 to No. 13 (Ga number omitted), and no other counter-proof exists.
In addition, there is no dispute over the following facts between the Plaintiff, Defendant C, F, G, and H, and Defendant D and E are deemed to have led to confession in accordance with Article 150(3) of the Civil Procedure Act.
1) On August 30, 2012, Defendant B leased from the Plaintiff the first floor of the instant building with a deposit of KRW 150,000,000, monthly rent of KRW 4,675,00 (including value-added tax), and a period of five years. The first floor of the instant building consists of ten stores. At the time of the contract, Defendant B sub-leaseed only four of them, such as the table Nos. 1, 4, 5, and 6 under paragraph (2) below.
The Plaintiff and Defendant B entered into a modified contract when the remaining store is sub-leased, and stated in the contract that “the remaining store shall immediately modify the lease contract” as the special agreement.
2) Defendant B, with the Plaintiff’s consent, subleted the first floor of the instant building to Defendant C, D, E, F, G, and H as follows. Serial sub-lessee (Defendant) deposit deposit monthly rent and value added store No. 1 C 11 (Order No. 1-b).
