1. The Plaintiff (Counterclaim Defendant) indicated the Defendant (Counterclaim Plaintiff, the appointed party) in the Appendix C No. 1233.
Reasons
1. Basic facts
A. The answer C, 1233 (hereinafter “instant land”) was owned by D, and D died on July 14, 1949, and E completed the registration of ownership transfer under its name on June 4, 1959, on the ground of Australia inheritance.
B. On April 12, 1996, E died on April 12, 1996, and his heir F, children G, H, I, J, K, and Defendant Appointed (hereinafter collectively referred to as the “Defendant”) succeeded to the land in this case by inheritance shares listed in the separate sheet (3).
C. The land of this case was in contact with the land of this case in order of L, 357 square meters and M, 261 square meters in the north-dong direction of the land of this case. However, on March 30, 1917, the registration of transfer of ownership in the name of D was completed, and on October 18, 1965, the ownership was transferred to N on the ground of the completion of repayment. The land of this case was transferred to N on August 5, 1921, and the ownership was transferred to N on the ground of sale, and thereafter the land of this case was transferred to N on December 4, 2003, and the ownership was finally terminated on July 7, 2008 under the Plaintiff’s name through P on May 12, 2004.
In the process, on September 13, 2004, 153 square meters was divided into Q. The remaining 204 square meters were combined into the above MM land. At present, Qu 153 square meters (hereinafter “ Q land”) and M large 465 square meters (hereinafter “M land”) are adjacent to the instant land in the form of “a”.
The Plaintiff occupies part of the instant land by forming a house and mail on the entire land of 50 square meters inside the ship (a) which connects each point of 164 square meters in sequence among M land and the instant land adjacent thereto, and of 5, 6, 7, 8, 9, 10, 11, and 5 of the attached Form (b) drawings, which connect each point of 164 square meters in sequence, among the land in the attached Form (a) drawings of 23,24, 25, 26, 32, and 23, and the attached Form (2) drawings.
