Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

Based on the fact that the credit transaction information of financial institutions is not shared immediately after the loan execution, the Defendant thought to obtain a loan from a large number of financial institutions within a short period prior to sharing the loan information in light of financial resources such as the Defendant’s income and property. On June 27, 2013, the Defendant made a loan application with a statement of intent to immediately repay the loan when a loan is granted from another financial institution during 15 business days from the five business days prior to the loan execution date and submitted it to the victim’s future life insurance company through C staff D, a loan recruitment company, to pay interest of 8.3% on a one-year basis, and to repay the loan after one year.

However, on June 26, 2013, the preceding day, the Defendant borrowed KRW 20,520,000 from the Korea Standards Bank on June 26, 2013, and applied for a loan of KRW 18,64,000 won on June 27, 2013, which is the same day, and at the time, there was no intention or ability to repay even if the Defendant received a loan because there was no particular property other than KRW 2,300,000,000 from the Defendant’s monthly wage and KRW 50,000,000.

On June 27, 2013, the Defendant received 30 million won from the victim to the account in the name of the Defendant on the pretext of the borrowed money.

Accordingly, the defendant was given property by deceiving the victim.
