1. The Defendant: 66,02,856 won to Plaintiff A, 50,000 won to Plaintiff B, and 20,000 won to Plaintiff D, respectively.

1. Basic facts

A. Plaintiff B and C are the parents of Plaintiff A, and Plaintiff D are the advisers of Plaintiff A, and the Defendant is the business operator of the School Safety Accident Compensation Mutual Aid Association to which the head of E High School was a party.

나. E고등학교에 재학 중이던 원고 A은 2013. 5. 31. 체육시간에 강당(체육관)에서 뜀틀 수업을 하던 중, 착지시 ‘우측 슬관절 전방 십자인대 파열, 우측 슬관절 내측 연골판 파열, 활액막염’(이하 ‘이 사건 부상’이라 한다)을 입었고, 2013. 8. 8. F병원에서 ‘관절경적 전방십자인대 재건술, 관절경적 내측 연골판 절제술, 관절경적 활액막 절제술’을 받았다.

C. On December 23, 2013, Plaintiff C filed a claim for disability benefits with the Defendant, but the Defendant rendered a decision on December 30, 2013 on rejection on the ground that “the Plaintiff’s current state of status A cannot be deemed completely excluded from the possibility of care for medical treatment, such as rehabilitation and physical therapy.”

Accordingly, on January 21, 2014, Plaintiff C filed a petition for review with the Standing Committee on Compensation for Safety at the Standing School on the ground that the said Committee dismissed the petition for review on March 20, 2014, on the ground that “the elebbbbbbbbbing sponsing of the degree of five meters generated to Plaintiff A does not constitute a person who has an obstacle to the function of one section among the three sections of the third sections of the bridge as stipulated in Article 12(7) of the Enforcement Decree of the School Safety Act (hereinafter “School Safety Act”).

(1) The relevant provisions (1) Article 37 of the School Safety Act shall provide the beneficiary or his/her guardian with the amount prescribed in Article 3(2)3 of the State Compensation Act and the consolation money prescribed in Article 3(5) of the same Act when the beneficiary who received the medical care benefits under the provisions of Article 36 has a disability even after the completion of the medical care (paragraph (1) and necessary matters concerning the criteria for determining the degree of disability and the calculation of the amount of disability benefits and the method for paying them.
