A defendant shall be punished by imprisonment for not less than three years and six months.
Reasons
Punishment of the crime
The Defendant was sentenced to three years of imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes in the Daegu District Court’s Port on July 24, 2003; on March 28, 2007, the Daegu District Court sentenced ten months of imprisonment and a fine of 200,000 won for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes; on February 19, 2008, the Defendant was sentenced to three years of imprisonment and a fine of 300,000 won by the Ulsan District Court on August 22, 2010.
The defendants habitually committed the following crimes.
1. At around 06:30 on June 27, 201, the Defendant: (a) boarded and entered the office entrance of D Co., Ltd. located in Nam-gu C to steal money and valuables; (b) opened the office entrance by force using a wooden board located in the neighboring area; and (c) attempted to steal money and valuables from the outside; (d) however, the Defendant did not escape from the warning of the guard company’s thief prevention device attached to the above office’s door and failed to realize that intent.
2. On July 201, 201, the Defendant entered the victim F’s house located in Nam-gu E at a time of port via an unlocked door, and cut off KRW 70,000 in cash inside the wall owned by the victim, who was located on the victim’s side at the inside of the inside of the wall, at the time of the port of Mapo-gu, Nam-gu.
3. At around 15:00 on October 26, 201, the Defendant: (a) opened and opened a locked door using the key from the home of the victim F located in Nam-gu, Nam-gu, E at the port; and (b) stolen the said door with the b85,000 won in cash located on the wall owned by the victim located on the part of the victim who was located on the part of the inner bed; (c) and (d) 100,000 won in cash located on the wall owned by the victim.
