Reasons
Punishment of the crime
1. Defendant A and Defendant B’s joint crime is the actual representative director of Company D (hereinafter “D”) established with the advertising agency, etc. as its business purpose, and Defendant B is the person who works as the head of the strategic planning department of the said Company.
As the Defendants were unable to enter into a service contract for an event that D is ordered by a public agency due to the default of taxes, four major premiums, etc., the Defendants were willing to submit a forged tax payment certificate, etc. to the public agency.
A. On September 2014, in order to participate in the bid for “F” services ordered by the Small and Medium Business Corporation at the D office located in Gangnam-gu Seoul Metropolitan Government, the Defendants forged one copy of the certificate of tax payment issued in the name of the head of Samsung Tax Office in the column of the trade name (name of a corporation) in the name of the head of Samsung Tax Office by using G H program at the said office using the aforementioned office’s computer.
From that time to January 2017, Defendants forged public documents in 23, including three tax payment certificates in the name of the head of Samsung Tax Office, one of the head of Gangnam-gu, six of the head of the tax office in the name of the head of the branch office, six of the head of the branch office in the name of the head of the branch office, six of the local tax payment certificates in the name of the head of the branch office, seven of the full payment certificates in the name of the president of the National Health Insurance Corporation, and seven of the documents in the name of the president of the branch office.
B. In order to participate in the F’s tender for “F” as ordered by the said Corporation on September 22, 2014, the Defendants of the forged official document exercising the tax payment certificate under the name of the head of the Samsung Tax Office, as stated in paragraph (1), is true.
