A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

[2014 Highest 6378] On June 2013, the Defendant: (a) retired the victim C, who had been running a singing voice, and was married with himself/herself; and (b) entered the victim into the wholesale and retail trade with the proprietor.

On June 10, 2013, the Defendant stated that “Around June 10, 2013, the Defendant entered KRW 150,000,000,000,000,000,000,000,000,000,000,000,000,00

However, (D) at the time, there was no particular sale, and there was no intention or ability to repay it even if it was borrowed money from the victim because it was not finalized to receive KRW 150 million.

As above, the Defendant, by deceiving the victim as above, received 1 million won from the victim in terms of sirens expenses from the victim’s position, and obtained from January 4, 2014 the sum total of 63,859,269 won, including business funds, etc., from around 51 times in total, as shown in the attached crime list, from around January 4, 2014.

1. On March 10, 2014, the Defendant: (a) during February 2014, 2014, the Defendant told the victim E at the office of the National Dental Welfare Association, an incorporated foundation located in the 34-7 Dongyang Building B Dong-dong 4, Jungcheon-gu, Jungcheon-gu, Seoul, that “The Defendant changed the boiler construction with a size of 170 million won to the golf course located in Chuncheon City; and (b) caused the construction to take place.”

However, even if the Defendant received money from the victim, he did not have the intent or ability to make the boiler replacement construction work take place.

On March 10, 2014, the Defendant, as above, was given KRW 1 million to the victim in cash as the expenses for giving orders for construction works, on or around March 10, 2014.

2. On March 20, 2014, the Defendant was guilty on April 11, 2014, and around March 20, 2014, at the foregoing Association office, the victim’s bathing boiler for staff members of the Ulsan Heavy Industries.
