1. The defendant is based on the transfer agreement on June 7, 199, on the motor vehicles listed in the separate sheet No. 1 list from the plaintiff.

1. Facts of recognition;

A. Before March 12, 1999, the Plaintiff transferred the instant automobile to C in lieu of performing obligations to C, and delivered documents necessary for transferring the ownership of the instant automobile, such as a certificate of personal seal impression, registration certificate, etc.

B. Around June 7, 1999, C entered into an agreement with the Defendant to transfer the instant vehicle to the Defendant (hereinafter “instant transfer agreement”), and accordingly, delivered the instant vehicle to the Defendant.

C. Under the instant transfer agreement, the Defendant, who received the instant vehicle from C, entered into a liability insurance contract with the insurance company, such as E, a father, etc. from June 7, 199 to February 21, 2002 under the name of father D, etc. and operated the instant automobile.

Since then on June 2002, the defendant re-transfer the instant automobile to FF.

2. Determination

(a) A person who has acquired a registered motor vehicle shall file an application for the registration of transfer of ownership with the Mayor/Do Governor, and where a transferee of the motor vehicle intends to transfer the motor vehicle to a third party, he/she shall make the registration of transfer in his/her name before transferring it, and where the transferee of the motor vehicle fails to file an application for the registration of transfer of ownership, the transferor (referring to the owner recorded in

(Article 12(1), (3), and (4) of the Automobile Management Act. Accordingly, a person who is registered as an owner in the automobile register can seek the procedure of transfer registration as well as a person who has been transferred or transferred by another person as well as a person who has been transferred or transferred by another person from him/her.
