1. As to the Plaintiff (Counterclaim Defendant)’s KRW 727,454,281 and its KRW 63,00,000 among them, the Defendant (Counterclaim Defendant)’s Plaintiff (Counterclaim Defendant) on June 16, 2018.

A principal lawsuit and a counterclaim shall be deemed simultaneously.

1. Basic facts

A. On October 20, 2017, the Plaintiff entered into a contract with the Defendant to accept a subcontract for the installation of soil works and soil mounds among the “construction of the instant building (hereinafter “instant building”)” and the main contents of the contract are as follows.

1. The name of the subcontracted project: The works of constructing new buildings in Kimpo C district and the works of installing new soil facilities;

2. Period: May 31, 2018 as of October 10, 2017.

3. Contract amount: Payment of 30 million won in daily gold (Won 1,430,000,000); and

(a) Advance payment: 50 million won in writing (Won 50,000,000) within seven days after concluding a contract;

(b) progress payment: within 15 days from the date of receipt of the object.

B. On November 14, 2017, the Plaintiff entered into a contract with the Defendant to accept reinforced concrete construction works (hereinafter “instant steel reinforced concrete construction works”) among the “construction works of a new building in the Gimpo District Complex” (hereinafter “instant construction works”). The main contents are as follows.

1. The name of the subcontracted project: Construction of reinforced concrete (four stories underground or ten stories above ground) from among the construction of new buildings in the complex of Kimpo C district;

2. Period: November 30, 2018 after completion of construction, November 14, 2017.

3. Contract amount: Payment of 30 million won in twenty million won (Won 2,420,000,000); and

(b) progress payment: within 15 days from the date of receipt of the object.

C. The design drawing, specifications, ground investigation report, etc. of the instant earth preventive facility construction refers to a construction method that continuously injects up the injection of net integrity and completedness through the inducement space formed on the ground as a kind of double and double-water complex construction method using the injection of the water oil system (GRUTING).

The construction work (hereinafter referred to as the “instant additional construction work”) was stated to be carried out, and the construction work specifications prepared by the Plaintiff and the Defendant are as mentioned above.
