Punishment of the crime

[criminal history] On May 8, 2007, the Defendant was issued a summary order of KRW 1 million for a violation of road traffic law at the Incheon District Court's Busan District Court's Branch on May 8, 2007; on November 6, 2008, the same court issued a summary order of KRW 1 million for a violation of road traffic law; on July 27, 2010, the same court issued a summary order of KRW 3 million for a violation of road traffic law (driving under drinking), and on November 16, 2010, issued a summary order of KRW 3 million for a violation of road traffic law (driving under drinking); and on November 2, 2014, the court was sentenced to imprisonment for 10 months and a suspended sentence of two years for a violation of road traffic law (driving under drinking).

[Criminal facts]

1. On August 10, 2015, the Defendant, despite the past record of the above crime, driven a D car under the influence of alcohol concentration of approximately 0.084% during blood transfusion without the driver’s license, from around 22:30 on August 10, 2015, to the road before the day after the 100-meter back of the 100-meter mnive apartment model back in the Eup-gu, Kimpo-si, Kimpo-si, Kimpo-si, the Defendant driven the D car under the influence of alcohol concentration of about 0.084%.

2. The Defendant in violation of the Guarantee of Automobile Compensation Act is a person driving a D car without a driver’s license.

Where any third person dies or is injured due to the operation of a motor vehicle, the owner of the motor vehicle shall subscribe to the mandatory insurance liable for paying a certain amount to the victim, and shall not operate any motor vehicle which is not covered by the mandatory insurance on the road.

Nevertheless, the Defendant, around August 10, 2015, driven the said vehicle, which was not covered by mandatory insurance, from around 22:30 on August 10, 2015, to the road in front of the day before the 100-meter 100 meters away from the day after the 100-meter stop at the Eup-Mari apartment, which was through Kimpo-si, Kimpo-si.
