나. 피고의 상표 등록 및 상표 사용 피고는 “”라는 상표에 관하여 1982. 11. 22. ‘모자, 넥타이, 숄, 스카프, 머플러, 목도리, 장갑, 블라우스, 와이셔츠, 조끼, 재킷, 카디건, 스웨터, 슈트’ 등을 지정상품으로 상표등록을 출원하여 1983. 8. 25. 그 등록을 마치고(상표등록번호 제94053호), 1982. 11. 22. ‘지갑, 핸드백, 서류가방’ 등을 지정상품으로 상표등록을 출원하여 1983. 8. 29. 그 등록을 마치고(상표등록번호 제94131호), 1997. 2. 5. ‘팔뚝시계, 회중시계’ 등을 지정상품으로 상표등록을 출원하여 1998. 2. 27. 그 등록을 마치고(상표등록번호 제397557호), 1997. 2. 5. ‘장화, 가죽신, 우화, 야구화, 골프화, 샌들, 슬리퍼’를 지정상품으로 상표등록을 출원하여, 1998. 6. 16. 그 등록을 마치고(상표등록번호 제404835호), 1995. 11. 2. ‘렌즈, 카메라, 선글라스, 안경테’ 등을 지정상품으로 상표등록을 출원하여 1998. 7. 18. 그 등록을 마쳤다
