A defendant shall be punished by imprisonment for two years.

Reasons
Punishment of the crime
[2012 Highest 473] The Defendant, from July 21, 2003 to August 201, 2010, was engaged in the fund management duties while taking charge of accounting and general affairs of victim D Co., Ltd. (hereinafter “D”).
1. On July 12, 2009, the Defendant, while managing the said company’s new bank account (Account Number: E) at the office of Yeongi-gu, Chungcheongnam-gu, Chungcheongnam-gu, and keeping the said D funds in business, embezzled KRW 16,05,169 in total from July 22, 2010, including transfer of KRW 223,275,152 to the Defendant’s national bank account (Account Number:F) from the said company’s account, and embezzlement KRW 16,05,169 in total, from July 22, 2010 to July 2, 2010, including transfer of KRW 223,275,152 to the Defendant’s national bank account (Account Number:F).
2. On July 12, 2009, while the Defendant managed the said legal entity’s account at the above office and kept the said D’s funds for business purposes, the Defendant transferred KRW 1,860,000 from the said legal entity’s account to the Defendant’s personal union account (the account number: the account number is subsequently changed to I) and then embezzled the total amount of KRW 40,447,269 as shown in attached Table 2, from May 18, 2010, and then embezzled all of them.
3. On June 11, 2010, the Defendant managed the said legal entity’s account at the above office and embezzled KRW 1,000,000 from the time when he/she deposited KRW 7,367,640 from the said legal entity’s account to the national bank account (K) of the Defendant (J). The Defendant embezzled KRW 47,534,460,00 in total, as shown in the attached Table 3, from the time when he/she embezzled the money by transferring KRW 1,00,00 to the Defendant’s new bank account (Account Number:N) with the Defendant’s wife’s wife, to August 28, 2010.
Accordingly, the Defendant embezzled the sum of KRW 254,038,898 as above.
