A defendant shall be punished by imprisonment for four years.

Punishment of the crime

The Defendant, as the head of the management support office of D and E Co., Ltd. run by the victim C from May 2006 to August 2013, 2006, was in charge of accounting affairs while managing the funds of each of the above companies.

1. Around July 20, 201, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Embezzlement) transferred 500,000 won from the said one bank account to the Korean bank account (H) in the name of the Defendant and embezzled 592,124,930 won in total over 110 times from July 30, 201 to August 30, 201, as shown in the attached Table No. 71 to 1180, a total sum of 110 times from the date of transfer of 592,124,930 won to the above bank account under the name of the Defendant, and then arbitrarily used it.

2. Around July 26, 2008, the embezzlement Defendant, at the D Office No. 1102 of the Gangnam-gu Seoul International Building 1, kept the public funds of the victim corporation D in the course of business in one bank account (Account Number: G) in the above company’s name, and, on the intent of using the Defendant’s public funds for living expenses, such as the Defendant’s amusement expenses, he transferred KRW 3,00,000 from the above one bank account to the Korean bank account in the name of the Defendant, used them as the Defendant’s living expenses, etc., and embezzled all of the amounts of KRW 409,754,924 as shown in the [Attachment] No. 1 through No. 7011, Jul. 7, 2011, by transferring them to the above bank account.

3. The Defendant: (a) around 12:00 on August 30, 2013, at E offices of Gangnam-gu Seoul Metropolitan Government F building 1118; (b) the victim C, the representative director of the said company, opened a credit cooperative used by the victim using the secret number known to the Defendant and opened a credit cooperative with the victim’s face value of KRW 10 million on the part of the victim.
