A defendant shall be punished by imprisonment for six months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
【Criminal Power】 On November 26, 2019, the Defendant was sentenced to one year of imprisonment with prison labor for a crime of violating the Customs Act at the Incheon District Court, and the said judgment became final and conclusive on June 25, 2020.
1. On April 24, 2018, the Defendant: (a) leased the said vehicle from B Co., Ltd. to D, and (b) lent the said vehicle to D, 7,000,000 won per month; (c) D lent the said vehicle to E in rent of KRW 54,50,000.
The defendant, who did not pay D's tea, had used the GPS location control system, which is installed in the above vehicle, to bring about the above leased vehicle.
On July 12, 2019, around 03:00 on 03:0, the Defendant discovered the above vehicle parked at the 'GPS location control system' at the 1st floor parking lot of the F building G in Seongbuk-si, and carried it through a consignee.
Accordingly, the defendant stolen the victim's property.
2. "20 Highest 5671";
A. A. A thief 1) around October 2017, the Defendant lent IWW car to H at KRW 4 million per car, and H re-leased the said vehicle to the victim J. When the Defendant was unable to be identified as a vehicle from H, the Defendant was willing to identify the location of using GPS installed on the said vehicle and used assist key. At around 07:00 on January 24, 2019, the Defendant: (a) opened a door of the said BM car parked at the front of the victim’s house located in the Incheon Sinnam-gun, Incheon, and took a stop; (b) after committing the crime of the above paragraph (1), the Defendant was not able to succeed to the name of the said BMW car, and was not able to return the said vehicle to the victim, and (c) was not able to use assist key after having known the location of using the GPS installed on the said vehicle. At around 13:00 on March 15, 2019, the Defendant set up the said BM car in Jeju.
