A defendant shall be punished by imprisonment for one year.
However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
[2017 Highest 927] The Defendant is not a narcotics handler.
1. On March 2015, the Defendant, at the D’s office located in Guro-gu Seoul Metropolitan Government Office No. 206, administered a philopon by taking the d, F, and E, in a manner of inhaleing smoke generated by heating it into a string machine, among the Melopic Meloptys (hereinafter “philopon”), which were purchased at KRW 50,000 from D, and Melopics (hereinafter “Melopon”), which were purchased at KRW 500,000 from D.
2. On April 2015, the Defendant, at the D’s office located in Guro-gu Seoul Metropolitan Government building 206, administered philopon by taking off the scopon from the 500,000 won, which he purchased from D, on the scopon, and inhales the smoke arising from the heating into the d, F, and E through the inhaler, and inhales it.
3. On June 28, 2016, the Defendant: (a) at D’s office located in Guro-gu Seoul Metropolitan Government Building 703, deposited KRW 500,000 from D to the new bank account used by the Defendant; and (b) sold phiphones in a way that D’s H seal parked in the above parking lot of the building, with which the quantity cannot be known on the front wheels of the passenger car; and (c) sold phiphones in a way that D would bring about it.
4. On September 22, 2016, the Defendant deposited KRW 500,000 from D’s office located in Guro-gu Seoul Metropolitan Government Building 703 to D’s new bank account used by the Defendant, and sold a philophone 1 piece of philophone with which the quantity cannot be known.
5. On October 9, 2016, around 23:00, the Defendant: (a) received KRW 500,000 from D from D; and (b) sold phiphonephones in a way that concealed 1 studio-phones, the quantity of which cannot be known in the toilets for the first floor of the building; and (c) sold phiphones in a way that caused D to bring it up.
6. On February 16, 2017, the Defendant is a restaurant with “J” located in Yeongdeungpo-gu Seoul Metropolitan Government I.
