Defendants shall be punished by a fine of KRW 3,000,000.

In the event that the Defendants did not pay the above fine, the Defendants did not pay the fine.

Punishment of the crime

On October 19, 2010, the Defendants: (a) filed a marriage report on October 19, 2010; (b) around April 2013, with D, Defendant B’s wife, and (c) obtained a birth certificate as if the said D was the Defendants’ children; (b) made a false birth report using the said certificate; and (c) conspired to allow the said infant to depart from Vietnam through the Korea-U.S. International Airport with a passport issued by the Republic of Korea stating the false fact as if the said infant was a national of the Republic of Korea.

1. On April 23, 2013, Defendant A submitted a false birth report to the public official in charge of the registration of family relationship in the above community service center, and had the said public official enter the birth report in the family relation registration system, which is a public electronic record, when Defendant B gave birth to Defendant B, even though there was no fact that Defendant B gave birth to G between Defendant B and the F community service center located in Daegu-gu, Daegu-gu, and the F community service center.

Accordingly, in collusion with the above D, the Defendants made false reports to the above public officials to enter false facts in the family relation registration system, which is a public electronic record, and exercised the public electronic records recorded as false by having the above public electronic records preserved.

2. Violation of the Passport Act and Defendant A, as stated in the preceding paragraph, filed a false report of birth of the said G as his/her child, and Defendant A was unable to acquire the Republic of Korea nationality because the said G was not his/her child and thus, in the Seocho-gu Office’s public service center located in the Daegu-gu Office around September 3, 2013, the said G was a person who was unable to acquire the Republic of Korea nationality.
