Defendant shall be punished by a fine of KRW 2,000,000.

If the defendant does not pay the above fine, 50,000 won.

Punishment of the crime

1. Around February 2013, the Defendant: (a) written comments on “sale of Internet co-owned implements” posted by himself/herself on the Internet C; (b) written comments on the victim D to the effect that “the price of the said co-owned implements is secret”; and (c) published the victim’s name, telephone number, photograph, etc. on the C website; and (d) expressed the victim’s insult.

피고인은 2013. 2. 2.경 광주 북구 E아파트 109동 1202호 피고인의 집에서, C 사이트에 접속하여, ‘D, F 남의 판매글에 싸게 사볼라고 시비 거는 양아치 공개 수배합니다’라는 제목의 글을 게시하면서, ‘씨바 재수 없는 면상’이라는 문구가 쓰인 피해자의 얼굴 사진을 게재하고, ‘이런 븅신쉐끼는 ’, ‘씨불 양아치 쉑끼 아시는 분은 쪽지 남겨주세요’ 등을 기재한 것을 포함하여, 그 무렵부터 2013. 2. 10.경까지 범죄일람표 1 기재와 같이 총 7회에 걸쳐 C에 글을 게재하거나 댓글을 작성하는 방법으로 공연히 피해자를 모욕하였다.

Nevertheless, on February 6, 2013, the Defendant sent text messages to the victim D’s cell phone (F) using his own cell phone (G) at the Defendant’s home for the foregoing reasons, including sending text messages for the following reasons: (a) from around 10 to around 22:33 of the same day, the Defendant repeatedly sent them to the victim text messages causing uneasiness, as shown in the annexed crime sight table 2.
