A defendant shall be punished by imprisonment for not less than eight months.

Punishment of the crime

On November 28, 2013, the Defendant was sentenced to imprisonment with prison labor for habitual fraud at the Jeju District Court on November 28, 2013 and completed the execution of the sentence in the Jeju Prison on January 13, 2015.

On July 6, 2016, the Defendant was sentenced to six months of imprisonment for fraud at the Jeju District Court, and the said judgment became final and conclusive on October 21, 2016.

(1) On May 4, 2016, the Defendant: (a) visited the Defendant’s residence in Jeju-si B A Dong 501 via a computer, and (b) falsely told the Defendant that “I will first deposit the price in advance and send two wheelchairss if I would do so.”

However, since the defendant did not possess the above goods, there was no intention or ability to deliver the above goods to the victim even if he receives the price.

The Defendant received KRW 350,000 on the same day from the victim to the account under the name of the Defendant, and acquired KRW 2,844,000 from the victims to May 17, 2016 on a total of four occasions, as shown in the attached crime list, from around that time, the Defendant acquired KRW 2,84,00 from the victims to the account under the name of the Defendant as the price for goods.
