Punishment of the crime
"2015 High Court 288"
1. On October 18, 2013, the Defendant: (a) around 16:00 on October 18, 2013, the Defendant: (b) had the victim D (ma, 34 years of age) receive KRW 1,50,000 from the opening of 3 mobile phones; (c) had the victim use 1 mobile telecom E (Mour IM-A860SD) under the victim’s name, 1 mobile telecom E ( Model SM-N90L), 1 LGUF G ( Model IM-A890K) with three mobile lines.
However, even if the victim lends his/her name, the defendant has no intention or ability to reduce 1.5 million won, and even if he/she opens a mobile phone and uses the mobile phone, he/she has no intention or ability to pay the cost of equipment and the fee.
As above, the Defendant had the victim bear a total of KRW 2,766,500 and the amount of KRW 699,60 and the amount of KRW 1,067,00 and the amount of KRW 99,90 and the amount of KRW 99,90 of the Plaintiff’s equipment value of LGU’s LGU, and the amount of KRW 1,06,00 from LGU’s equipment value of LGT’s G, thereby taking economic benefits equivalent to the same amount.
2. On October 24, 2013, at a place where it is impossible to know at the time, the Defendant issued a letter of official approval to the victim D, and installed a smart banking system in the mobile phone in the name of D that received the above, and then processed information with a security card number and an official certificate number without authority by inputting it into smart banking without obtaining authority, and received 22,300 won from the NA account in the victim’s name to the NA account in the victim’s name, and acquired the same amount of pecuniary profit.

3. At around 7:10 on November 4, 2013, the Defendant stolen the amount equivalent to KRW 1,300,000 in cash, which was contained in the victim’s small iron safe and coffee machine, using crepans in order to steal money and valuables, within a set of time frame operated by the victim K (Nam, South and 34 years of age) in Tong-siJ.
