피고인은 2018. 5. 12. 02:48 경 부천시 C에 있는 'D 호프집 '에서 “ 옛날에 사귀던 사람이 깽판을 치고 있다” 는 112 신고를 받고 출동한 부천 오정경찰서 E 지구대 소속 순경인 피해자 F으로부터 인적 사항을 밝히기를 요구 받자 다른 손님들이 있는 가운데 피해자에게 " 뭐 이런 걸로 짭새들이 오냐 꺼져 라 짭새 들, 씨 발 새끼들" 이라고 큰 소리로 욕설하고, 계속하여 위 장소에서 100m 가량 떨어진 부천시 G 앞 길까지 이동하면서 피해자가 따라가 인적사항을 밝히기를 요구하자 주위에 사람들이 있는 가운데 피해자에게 " 잡지 마라 죽는 거야 새끼야, 놔 새끼야, 까불지 말고 임 마, 까불지 말고 이 새끼야 "라고 큰 소리로 욕설을 하여 공연히 피해자를 모욕하였다.
