A defendant shall be punished by imprisonment for not less than eight months.
except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant is a person who is engaged in driving a Bpick 110cc motor bicycle.
1. On May 21, 2019, the Defendant violated the Act on Special Cases Concerning the Settlement of Traffic Accidents (Bodily Injury) entered a three-lane road in Do while driving the said motorcycle while under the influence of alcohol at 0.159% of blood alcohol concentration, without obtaining a driver’s license, and driving it at the speed of 0.159% in south-gu C at port.
There are three-lanes of farming roads. In such a case, a person engaged in driving a motorcycle has a duty of care to safely drive and prevent accidents by safely driving by checking whether a motor vehicle is driving on the road.
Nevertheless, the Defendant, while driving a drinking or non-exclusive license, was negligent and entered into the two-lanes of the above road as it was, followed by the negligence of entering the two-lanes of the above road, and received the front right side of the victim E(21 years old) driving as the front side of the driver's license.
Ultimately, the Defendant suffered, by such occupational negligence, the injury to the victim E, such as salt ties and tensions that require approximately two weeks of medical treatment, and the injury to the victim G (V, 22 years of age) who is a passenger of the instant rocketing car, including salt ties and tensions that require approximately two weeks of medical treatment.
2. The Defendant driven the above motorcycle while under the influence of alcohol with the blood alcohol concentration of 0.159%, without obtaining a motorcycle driver’s license, from the distance adjacent to H in south-gu at the time of the temporary border as set forth in paragraph (1) to the place of accident as set forth in paragraph (1) at approximately 300 meters.
