A defendant shall be punished by imprisonment for four years.

The defendant shall be ordered to complete a sexual assault treatment program for 80 hours.

Punishment of the crime

The defendant was aware of the fact that the victim E (the age of 53) was unable to hear well and that there is a serious fall in the ability to discern things, etc., and thus, the refusal or resistance to sexual relations is considerably difficult.

1. On October 201, the Defendant violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (rape-rape, etc. against the disabled) committed one sexual intercourse with the victim who was unable to resist due to any mental disability within the said vinyl, in the vicinity of G’s vinyl, a dong residents living in the same dong-gun F, Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, who was located in the nearest P.M. on the same date.

On February 2012, the Defendant: (a) at the Defendant’s house located in the Macheon-gun, Chungcheongnamcheon-gun, Chungcheongnam-do, Chungcheongnam-do; (b) at the Defendant’s house located in the Chungcheongnam-do, the Defendant’s wife laid his house in Seoul, left his house in Seoul, and went out to the Defendant’s house; and (c) sexual intercourse once with the victim in a state of mental disability, who is unable to resist.
