원고는 피고로부터 아래 1)항과 같은 폐기물 종합재활용업 허가를 받고, 피고에게 2)항과 같은 가축분뇨재활용 신고와 3)항과 같은 비료생산업 등록을 한 회사이다. 폐기물 종합재활용업 허가 - 영업 대상 폐기물 : 동ㆍ식물성 잔재물 및 오니류 - 재활용 제품 : 비료(퇴비) - 보관시설 : 756㎥, 허용보관량 : 750톤(≒15일분) - 재활용 시설 처리시설 : 퇴비화시설(이하 ‘이 사건 퇴비화시설’이라 한다
