A defendant shall be punished by imprisonment with prison labor for four months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The Defendant is a person who operated “C”, a mobile phone sales store in Gwangju North-gu, from November 2013 to August 2014.
1. On August 7, 2014, the Defendant subscribed to SK Telecom cell phone: (a) stated the above D’s resident registration certificate, which was kept in custody of D at the above mobile phone sales store, as “he subscriber D, resident registration number D, and E” in the contract for the new mobile phone of the SK Telecom; and (b) forged one copy of the application form for the establishment of a mobile phone in the name of D, which is a private document concerning rights and obligations, and submitted it to the staff of SKcom Co., Ltd. who did not know that the said application was forged.
In addition, the Defendant pretended that the above D would purchase the normally mobile phone and pay the payment thereof, and it did not pay 1,165,400 won of the cost of telecommunications use and the cost of mobile phone from the Selcom Co., Ltd. to January 2015 after receiving the mobile phone amounting to 866,800 won at the market price.
2. On August 28, 2014, the Defendant subscribed to KT Mobile Co., Ltd.: (a) made use of a copy of the above D’s resident registration certificate, which was kept in possession of D’s mobile phone at the above mobile phone retail store; (b) made use of a copy of the said D’s resident registration certificate, stating “D applicant D and resident registration number E”; and (c) made use of a copy of the D’s new contract; (d) forged a copy of the application for joining the D’s mobile phone, which is a private document pertaining to rights and obligations, and submitted it to the staff in charge of KT
In addition, the Defendant pretended to purchase the above D normally and pay its payment, and received the mobile phone equivalent to 149,400 won at the market price from KT Co., Ltd. and received it.
