Defendant

A shall be punished by a fine for negligence of KRW 4,000,000 and by a fine of KRW 300,000, respectively.

The above fine is imposed against the Defendants.

Punishment of the crime

1. Defendant A is a person who is engaged in driving Cone Star Co., Ltd.

On August 24, 2016, the Defendant driven the above van at around 14:25 on August 24, 2016, and led the Defendant to turn to the left at the seat of the international passenger terminal located in the Seocho-dong International Passenger Terminal, Busan.

Since the location was an intersection where signal lights are installed, in such a case, a person engaged in driving a motor vehicle has a duty of care to safely drive the motor vehicle in accordance with the signals by reducing speed and by properly examining the right and the right of the motor vehicle.

Nevertheless, the Defendant neglected to do so and went to the left without stopping in front of the stop line, even though he changed to a straight line that could have a right turn and left turn before entering the intersection, and caused the collision of the victim B (59 years old) driving D's left part, which was going to the left part, due to the failure of stopping in front of the stop line and the failure of left turn to turn to the left.

After all, the Defendant suffered damages to the victim B, who did not have any open room within the lecture requiring approximately eight weeks of medical treatment by occupational negligence as above, and injury to the victim E (V, 60 years of age) who was on the ground of the above Orababa, such as the closure of the Ethababa, which requires approximately six weeks of medical treatment.

2. On August 24, 2016, Defendant B driven approximately 2 km from the front side of the Defendant’s house located in the Youngdo-gu Busan to the front side of the international passenger terminal in the Seocho-dong-dong-dong-gu, Busan without obtaining a bicycle driver’s license for a motor device at around 14:25 on August 24, 2016 to the intersection of the international passenger terminal.
