1. The summary of the facts charged is the representative director of the E-B Bank.

Around March 2013, the Defendant stated that “Asan City Construction Project is implemented under a contract with the said E Co., Ltd. (hereinafter “E”) from Asan City (hereinafter only referred to as “E”) to the victim I, the representative of Asan City in charge of the said construction project, “Asan City, upon delivery of aggregate used for the said construction project, will issue a tax invoice listed at the end of July 2013 and settle the price by issuing it at one time after receiving the construction cost from Asan City at the end of July 2013.”

그러나 사실은 위 E은 부실자산운영에 따른 재무구조 악화로 인한 자본금 부족으로 이미 2011년 등록기준 미달로 영업정지를 당한 전력이 있는데다가 2012. 11.부터 본격적으로 실시된 J의 2012년 부실ㆍ불법 건설업체 실태조사에서도 여전히 위 E의 자본금 부족에 의한 등록기준 미달사실이 드러나 곧 토목건축공사업의 등록말소가 예견되는 상황에서 2013. 5. 그 등록말소 사전처분 통지를 받아 위 아산시 G 건립공사를 정상적으로 시행할 의사나 능력이 없어 아산시로부터 공사대금을 받더라도 모든 하도급업체에 정상적으로 대금을 지급할 의사나 능력이 없었다.

As such, the Defendant, by deceiving the victim as above, received aggregate amounting to KRW 84,751,700 from March 29, 2013 to July 31, 2013, from the victim, aggregate amounting to KRW 84,751,700 from the victim’s purchase of aggregate amounting to KRW 84,70 from March 29, 2013, and from August 5, 2013 to the victim’s delivery of materials amounting to KRW 226,50,70 in total, or construction machinery rental or water supply, waterproof construction, etc., respectively, acquired property benefits equivalent to the same amount from the victim’s nine by receiving the said method as indicated in the list of crimes.

A. Whether fraud is established through the acquisition of pecuniary benefits equivalent to the construction cost should be determined at the time of the contract, and changes in economic conditions after the contract is concluded.
