A defendant shall be punished by imprisonment for not less than one year and six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Around January 13, 2020, the Defendant entered into a lease agreement on the above studio under the name of "E" with the victim D, the owner of Gangnam-si B building and the studio C, and sold the above studio to the purchaser of the used goods on April 18, 2020 at around 13,00 won of the market price owned by the victim and at around 500,000 won of the studio, which was installed for the purpose of enabling the lessee to use inside the above studio. On April 7, 2020, the Defendant sold the above 13,000 won of the studio to the purchaser of the used goods on the name of the above studio at around 18:30 on April 6, 2020, from the above 08:00 on April 7, 200 to the above 305,000 won of the studio.

Accordingly, the defendant embezzled the victim's property.

2. On April 8, 2020, the Defendant was unable to live in the above studio C, which he leased and resided in the above studio C, and thus, he was able to receive a refund of KRW 550,000 from the victim D, the above studio owner, the above studio owner, about the fact that he could receive a refund of the remaining deposit amount of KRW 550,00 from the above studio.

At around 16:20 on April 8, 2020, the Defendant attached a fire to approximately three strings of test-propin plastic paper, which was first possessed, and laid down on the surface near the wall, and caused the fire to spread to the floor and the wall of the above strings.

As a result, the defendant set the above room owned by the victim by 10 households with fire to a building used for residential purpose, and set the repair cost of approximately KRW 8,00,000.
