A defendant shall be punished by imprisonment for not more than ten months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

The Defendant is a person who operates the “C”, which is a mobile phone sales store, on the first floor of the building located in Ansan-si.

1. On January 24, 2018 and February 6, 2018, the Defendant posted an advertisement “at least 7,50,000 won per mobile phone, receiving cash, using a mobile phone” by accessing the Internet D website.

Accordingly, the Defendant made an advertisement that solicits the Defendant to enter into a contract for the provision of telecommunications services necessary for the use of mobile devices on the condition of providing funds.

2. Making a mobile phone financial service;

A. On July 15, 2015, the Defendant: (a) on July 15, 2015, 6 mobile phones in the E mobile phone name: (b) made E open two mobile phones from July 15, 2015; and (c) immediately paid KRW 500,000 to E; and (d) sold it to a heavy-phone purchaser at that time.

(2) On September 11, 2017, the Defendant: (a) provided four mobile phone calls from C to E on September 11, 2017; and (b) immediately paid KRW 700,000 to E; and (c) sold the mobile phone calls at around that time.

B. On September 12, 2017, the Defendant 2 of the F mobile phone name: (a) from C to F via two cell phoness; (b) immediately paid KRW 600,000 to F; and (c) sold the mobile phone purchasing company around that time.

C. On November 8, 2017, the Defendant in the name of G mobile phone: (a) from C to G via five mobile phones; (b) immediately paid KRW 2.17 million to G; and (c) sold the mobile phone purchasing company around that time.

On March 6, 2018, the Defendant, in the name of H, allowed H to open three mobile phones from March 6, 2018, and immediately paid 450,000 won to H, and sold it to a medium-phone purchasing company around that time.

Accordingly, the defendant entered into a contract for the provision of telecommunications services in another person's name, and opened 16 mobile communications devices, and uses telecommunications services provided to the mobile communications terminal.
