Defendants shall be punished by imprisonment for ten months.

However, as to the Defendants for three years from the date this judgment became final and conclusive.

Punishment of the crime

1. Defendants’ violation of the Telecommunications Business Act

(a) No person shall solicit, arrange, or mediate a contract for the provision of telecommunications services necessary for the use of a mobile communications terminal on the condition that funds are provided or lent;

Nevertheless, around May 21, 2018, the Defendant and C received 2.4 million won from D in the E-benz car in the name of D parked on the Daejeon ICT, which was parked on the roads adjacent to the Daejeon-gu Daejeon-dong-dong, and prepared 5 copies of the application for new mobile phone subscription service (iF, ②G, H, I, and ⑤J) and delivered to D, thereby allowing D to open 5 mobile phone calls.

Accordingly, the defendant, in collusion with C, recommended contracts on communications services necessary for the use of mobile communication terminal devices on condition of providing funds.

(b) No person may intermediate a third party's communications through telecommunications services provided by a telecommunications business operator, or provide such services for communications of a third party;

Nevertheless, around May 21, 2018, the Defendant received KRW 240,00 from D in the name of EWz car parked on the roads adjacent to Daejeon ICT, which was parked on the roads adjacent to the Daejeon ICT, and prepared five copies of the above mobile phone subscription service application form, and delivered to D, and let D open the above mobile phone five units, thereby providing telecommunications services provided by the telecommunications business operator for the purpose of communications.
