A defendant shall be punished by imprisonment for six months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

On July 20, 2010, the Defendant entered the Republic of Korea as a non-professional worker E-9 (Non-professional worker) and whose stay period has expired on May 21, 2015, is a foreign worker of Sri Lankan nationality.

In 2015, the Defendant received a proposal from D (hereinafter referred to as D) to the effect that “D (hereinafter referred to as “D”) to the effect that “in order to get home to board and land from Jeju Island,” and received a transfer of KRW 400,000 from D to his/her head of the Tong, and received the transfer of KRW 400,000 from D to his/her head of the Tong, who works together with the “G” (hereinafter referred to as “G”) in the Gu, Si, Si, Si, Si, Gun, E, in Jeju-do, for the purpose of gathering a foreigner registration certificate from D.

The Defendant, not aware of the aforementioned circumstances, called “I am playing in Jeju-do, as the Party is to bear all the expenses for local travel in Jeju-do”, went to Jeju-do along with G on April 4, 2015, and went to Jeju-do along with G around 07:30.

1. On April 4, 2015, the Defendant made a false statement to the effect that “The Defendant, while making a Jeju-do trip with the victim G, he was making a false statement to the effect that “I will diving the alien registration certificate to be used for reservation of distribution” to the victim during the Jeju-do trip with the victim G.

However, in fact, the defendant received a victim's foreign registration certificate and had D think that D will use it when he takes vessels from Jeju Island to land, and did not think that D will return it to the victim.

As above, the Defendant deceivings the victim, namely, obtained a foreign registration certificate owned by the victim from the victim in the seat and acquired it by deception.

2. The Defendant, while boarding a vessel departing from the port of State by D, was aware that D intended to produce G’s foreign registration certificate as G, he received KRW 400,00 from D and acquired the said KRW 40,00 from D at the time and place specified in paragraph 1.
