A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On September 7, 2015, around 01:25, the Defendant: (a) confirmed that the business of the said restaurant was completed; (b) opened a cafeteria, removed the toilet, and intruded into the cafeteria; (c) opened a cafeteria’s safe using a gate located in the cafeteria, but (d) led one bicycle equivalent to KRW 300,000 at the market price owned by the victim E, who was in the cafeteria.

Accordingly, the defendant stolen the victim's property by intrusion on the victim's structure at night.

2. 야간주거침입절도 피고인은 2015. 9. 7. 02:30경 남양주시 F에 있는 피해자 G 및 피해자 H의 주거지에 이르러 현관문이 열려 있는 것을 확인하고 안으로 침입한 다음, 피해자 H의 방에서 위 피해자 소유인 5,000원 권 롯데상품권 2장, 현금카드 1장, 자동차운전면허증 1장 등이 들어 있는 가방을, 계속하여 피해자 G의 방에서 위 피해자 소유인 현금 73만 원, 시가 9,900원 상당의 유니클로 티셔츠 1벌, 시가 98,600원 상당의 지오다노 청바지 1벌, 시가 16만 원 상당의 해지스 갈색 지갑 1개, 시가 55,000원 상당의 지샥 시계 1개, 농협은행 통장 2장, 주민등록증 1장, 운전면허증 1장 등이 들어 있는 시가 40만 원 상당의 TUMI 가방을 가져갔다.

Accordingly, the defendant invadedd the victims' residence at night and stolen the victims' property.
